Silent Bob Jerkero is our expert on travel law. He's a little busy now, today being Superbowl Sunday and all, but he asks me to advise you both to press for compensation.
The way to do it is by Small Claims court in Canada. Don't expect any satisfaction from other organisations like BBB, but give them a try.
For the trip to Cancun, the Montreal Convention will apply. For the trip to Antigua the Warsaw Convention applies, as Antigua did not ratify the Montreal Convention.
But for both Conventions, passengers are entitled to damages for delay and for delayed/lost bags.
The Small claims court claims only involve filling out forms and standing in court and saying in your own words what the problem was. The good part is that airlines do not usually show up and they allow judgment to go by default.
Silent Bob Jerkero advises that to say stay away from Air Transat is not the best approach. Air Transat is a low cost carrier that charges lower fares than airlines such as Air Canada and we should want them to stay in business to keep air fares competitive. We also should want them to be profitable so that they can compensate us when we are wronged by their people.
