Default Reinstatement of Miles Fraud

Below is my email to the US Airways Complaint Dept:

To whom it may concern,

I am writing to lodge a formal complaint regarding an offer made by US Airways that was not fulfilled. I have now spoken to 5 US Airways specialist to address the reinstatement of 25,953 miles. When I visited the US Airways website earlier this year, I received the following message (see attached screen capture below):

Miles in your account have been forfeited due to inactivity. To reinstate these miles, you can buy a ticket and fly at least one flight on US Airways by 10/30/2011. You can also reinstate these miles with one of our credit or debit cards or pay a reinstatement fee.

According to the explicit instructions in this message, in order to reinstate my miles, I needed to:
1) buy a ticket and
2) fly at least one flight on US Airways by 10/30/2011

I fulfilled both of these conditions and never received my reinstatement. There was no further requirement regarding this offer; clicking on the link to "buy" the ticket takes the user directly to the "Book Travel" webpage. On Aug 6, 2011, I flew on US Airways flight 430 fulfilling the requirements. I spoke to multiple agents, most recently today (Aug 29, 2011), and they said that in order to get those miles reinstated I needed to apply the new miles to my US Airways dividend account. This was not stipulated anywhere as part of the reinstatement, and if I had known that I would have used my miles towards the US Airways dividend. The coordinating supervisor I spoke with on the phone today, Kathy (DJ), was not only unhelpful but condescending in her tone as she communicated that these policies were obvious and did not need to be written explicitly. As a frequent traveler, I am appalled by the disrespectful nature of your supervisors.

I am extremely upset about this issue. I believe that legally this constitutes an offer and acceptance which you must honor, otherwise your actions constitute a breach of contract and may even be considered fraudulent, especially as your own representative acknowledged that there were no other written requirements on the website. I expect a full reinstatement of my mileage or I will proceed with legal action and a complaint to the Better Business Bureau as well as the Department of Transportation. I will escalate this issue further until this has been satisfactorily addressed.
