Default Reservation CANCELLED!

On July 12, 2012, I booked a trip to Florida with a girlfriend to coincide with our husbands' hunting trip - November 14th to 19th. At that time, the purchase price was $367 for 2 round trip tickets from Detroit to Tampa, seat selections and one checked bag each for both of us.

Today, I attempted to log in to print our boarding passes with no luck. After finding a telephone nubmer for Spirit, I called the 800 number. The first person I spoke with (who I had a hard time understanding) stated that my reservation had been cancelled on September 21, 2012 on-line and there was nothing he could do about it. I explained to him that that was impossible because not only did I not cancel my reservations, it would have been impossible because I was out of town in northern Michigan and DID NOT HAVE INTERNET access which I can prove because there were 4 other people with us. After getting nowhere, I asked to speak to a supervisor. After being put on hold for more than 25 minutes, Baxtin came on the line and it was like he was reading from the same script. All I wanted was to have my reservations put back - which Baxtin said they could do but now the price would be $801.00 - UNBELIEVABLE. I then requested a manager at which time I was again put on hold for more than 15 minutes and spoke with Phil (another mouthpiece) I got absolutely no where. i asked for the e-mail confirmation that was sent by Spirit when the reservation was cancelled - they could not produce it for me. I also said no credit was placed on my credit card - Oh didn't they mention, I have a credit on my Spirit account - I DON"T WANT A CREDIT ON MY SPIRIT ACCOUNT. After a bit more back and forth, I was assured that a refund would be placed on my credit card.

I find this whole situation completely UNBELIEVABLE! I then attempted to call Spirit back and I asked to speak with a "manager in the United States" and was informed that there were none!!!!!!

I am sooo upset - no long weekend in Florida and terrible customer service!!!

You should talk to the credit card on which you made the purchase about this situation. The Fair Credit Billing Act gives you the right to dispute charges made to your credit card for goods that were not recieved as agreed. If your reservation was charged to your credit card and then cancelled without your involvement, that would certainly seem to be goods not received as agreed. I suggest that you call Spirit back and demand that your card be credited in the amount of all charges within 24 hours and let them know that failure to do so will result in your disputing the charges with the CC. It usually takes a credit 3 to 5 days to post to your account, but you can call your credit card and they CAN check to see if the credit has been issued.

The FCBA limits the filing date to 60 days from the date of the first statement on which the charges appeared, so you should contact your card ASAP. The issuing bank DOES have the option to extend this time limit if they wish. The purchase also must have been more than $50 and made within 100 miles of your home address. How the issuing bank chooses to handle this rule for internet purchases is at their disecretion. In any case, it can't hurt to ask them about the dispute. If your issuing bank accepts the dispute, the bank will investigate the validity of the charges. If the dispute is resolved in your favor, the bank will just charge the money back to Spirit and that is that. Good Luck!

I would also take this to the DOT. This is highly suspicious. They are unable to detail how the reservation was cancelled, but you can prove that it was not cancelled by you. They did not refund your charge and they did not send out a confirmation email. I think they are in breach of contract. They are obligated to transport you to Florida at the price they agreed. You should file a complaint with the DOT and I would also copy the complaint to your local State Attorney Generals Office. Spirit are a nightmare..>I personally would never use them...but they have to obey the law.
