Default Compensation due ? LHR-AUH-BKK (delayed at AUH)

Non EU airline but departing from an EU airport (LHR) and through ticketed to final destination where we arrived 12 hours late.

Seems an obvious case for €600 compensation each but Etihad says no and offers only 20k miles.

Etihad writes:

Please allow me to explain that, your outbound journey consisted of 2 flights, EY18 from London to Abu Dhabi and EY404 from Abu Dhabi to Bangkok. To be considered for EC compensation, your delay had to be on your flight EY18; departing from an EU country.

Although this was a “through” ticket, the connecting and delayed flight EY404 was not departing from an EU country, and therefore you are not entitled to compensation under the EC regulation.

I think we are entitled. Any views ?

Just what they said. EU compensation rules only apply to flights depating the EU. You flight EU404 originated from Abu Dahbi it being late did not qualify you for EU compensation.

I appreciate there was a change of planes but we and our baggage were through ticketed to final destination departing an EU airport on the same carrier.

We did not pay for each leg separately and boarding passes for each were issued at LHR.

The ticked was advertised and priced as LHR-BKK and the change of plane was Etihad's choice, not ours.

I appreciate the second plane did not depart from an EU airport but our journey to destination did, which is what I thought the ruling required ?
