Anyone know a good travel lawyer? Booked tickets in Sept through AAA for a June trip. We arrive at the airport for our flight home and are told the flight was cancelled in Dec. "There is nothing we can do for you." AirOne blamed the travel agent. Either way we were at the airport with a ticket home for a cancelled flight. We never received any compensation for our cancelled flight home.
We had to purchase DAY OF tickets home (according the AirOne and AirItalia associate this was the ONLY solution.) We go to AAA when we get home. Apparently they never received the transmission that the flight was cancelled. They are in contact with AirOne who says it will take 180 days to process the claim. If AAA calls again "it will take longer." Who is responsible, AAA or AirOne for refunding our out of pocket expense? It was a lot of money (as you can imagine) to put on a credit card. |

That's a good one. before you can get a lawyer we need some clarity. First was the flight cancelled? If so what was the reason? If it was cancelled due to weather, mechanical, etc, AirOne should have rebooked you as a courtesy on the next available flight. But if they are blaming the travel agent, then it sounds like your ticket was cancelled which is a whole other can of worms. If your TICKET was cancelled then definitely look at your travel agent first and find out why they cancelled the ticket. This could be a back and forth battle, but once you figure out which one it is, either a cancelled flight or cancelled ticket then it should be easy to go from there.

I think a lawyer will ask for a copy of the contract of carriage which you agreed to upon booking. I am sure it will state that you are responsible to verify your flights and make the appropriate changes when needed. Not sure what happened but I am sure a lawyer will charge you a pretty penny. The nature of the cancellation and reason for lack of communication play a role in liability. Either way, it is your responsibility to check your travel plans. Good luck to you.

The travel agency is the one responsible. Anytime you book thru an agency (even an online one) they are fully responsible for notifying you of a schedule change and making other arrangements. The agencies very rarely ever give the airline your phone number. The number the airline will have listed is the agency's number. I also don't buy that about they didn't get the transmittal, but whatever.
Another part of this - did you ever call the airline to re-confirm your flights??? Lastly - WHY IS THIS LISTED UNDER AIR CANADA???????? |

I am going through the same at this time. I booked through cheap tickets, phx to dulles to rome. Logged on two weeks before my flight only to see that the rome portion was missing. Everyone is pointing the finger at the other entity. I asked cheap tickets why they didn't notify me. Pretty much I am talking to kids from the Philipines who are very good at reading their scripts. I am suppose to leave in 8 days and have no confirmed flight. Apparently cheap tickets can only communicate to Air one via email. Air one and Atalia say it is a nightmare since the merger. I have been asked if I would like to cancel but I have prepaid non-refundable hotel reservations. I guess I have to wait it out. They tell me to wait until Monday which is four days prior to my departure. Ugh! I will never book through a web site again airline travel again. Good to hear that cheap tickets is responsible, .... I think.

I know in these tough economic times a lot of people are losing money because of a company going out of business. So I can understand that Air One had financial troubles and merged with Atalia, but Cheaptickets did not informed me of the changes. I hold them responsible. I have purchased numerous domestic flights through them and never had problems, but I will never use them again. They have taken no responsiblity in this. Yesterday four days prior to my original departure they admitted that the flight was really cancelled and maybe I will get a refund from Atalia. I have since faxed Visa a formal complaint and hopefully they will be able to reach back into cheaptickets bank account and reverse the charges. Cheaptickets say they never had my money although my bill states that they did. I bought new tickets from Northwest, leaving in 8 days. I did not want to miss this trip. Will keep you posted.

I did buy travel insurance, they say it is only good for illness related cancellations.

I origianlly tried to cancel the flight because of loss of work for my travel companion months ago. Access America said that loss of income was not a reason to cancel the flight, declined. No where in there documentation does it state that once a claim is filed that the policy is cancelled and that you have to buy a new policy. I just called to let them no of my new travel dates and was told that the policy doesn't exist anymore. I asked 'on what page is that rule written on?" It's not was the reply. I guess that is suppose to be common knowledge. I see another complaint to Visa.

Glad to hear this didn't totally wreck your plans and that you've re-booked your travel on another airline. We're fortunate in Phoenix to have many choices for both domestic and international air travel and because we're a "hub" city for two major airlines fares are pretty competitive across the board. I shudder to think what might happen to Phoenix Sky Harbor and the Valley's economy if US Airways was to go belly-up.
I hope CheapTickets does the right thing and refunds your money. They lied when they told you to expect a refund directly from AirOne/Alitalia. When you paid CheapTickets your money did eventually go to AirOne but through the agency. Since they are the agent they should initiate the refund request. AirOne should refund ChepTickets through their IATA settlement account and then CheapTickets should, in turn, refund the money back to your credit card. Of course disputing through your credit card can't hurt and will likely expedite things. As for your insurance that's just downright absurd. I've heard some stories about Access America and this sounds just like something they would pull. I had a friend who cut his vacation short a couple of years ago because he pulled a muscle in his neck and shoulder and wanted to return home to see his chiropractor. He paid the change fees, etc. and filed a claim with all of the documentation the insurance company required. He actually saw the Chiropractor the afternoon he arrived home and faxed everything from the doctor's office. His claim was denied because he had been seeing his Chiropractor off and on for several years and they deemed his injury a pre-exisitng condition based solely on that fact! I posted in this thread about another travel insurance company which seems to offer more comprehensive coverage including coverage for loss of or change to employment. You might want to check them out before taking your trip. |

I purchased 2 tickets directly from AirOnes website from chicago to Rome in March 2009. They cancelled my flights so i have been waiting for my refund since May! Now there isnt even a 888 number to call, it has been disconnected. What do i do?

If you charged your ticket on a credit card and the airline cancels the flight, you are entitled to a refund from your credit card issuer."Dispute" the charge (your statement will explain what you need to do) since you did not receive the service that you paid for. Credit card companies withhold funds from airlines until the flight has taken place. If it never takes place, you will be issued a refund and the airline will not be paid.
